Dette må du vite om flyselskapet ditt streiker

Det er ikke lenge siden Norge ble satt på hodet da reisende ble rammet av en massiv streik hos flyselskapet SAS. For mange passasjerer måtte ferien avlyses fordi flyet ikke gikk, eller man ble booket om mange dager senere.

Med jevne mellomrom opplever vi at flyselskaper streiker. Dessverre er ikke folk flest klar over at du kan ha krav på å både få refundert billettprisen, ombooket billettene samt erstatning dersom flyet ditt blir forsinket eller kansellert som følge av streik.

Dette er dine rettigheter neste gang SAS eller et annet flyselskap er tatt ut i streik.

Dersom flyet ditt blir kansellert som følge av streik hos et flyselskap har du krav på følgende av flyselskapet ditt.

  1. Du kan kreve at flyselskapet refunderer flybilletten din for den delen av en reise som du ikke får benyttet fordi flyet blir forsinket eller kansellert, eller
  2. du kan kreve at flyselskapet booker deg om til en annen flygning slik at du kommer frem til din destinasjon så raskt som mulig, eller
  3. du kan kreve at flyselskapet booker deg om til et senere avreisetidspunkt, der den nye billetten skal ha samme vilkår som den opprinnelige billetten (f.eks. samme billettklasse).

Du kan altså som hovedregel kreve at flyselskapet enten refunderer flybilletten din eller booker deg om til et senere tidspunkt dersom flyet ditt blir innstilt som følge av streik.

Dersom du velger å la flyselskapet booke deg om har du i tillegg krav på å få dekket nødvendige kostnader til hotell, mat, drikke samt transport til og fra flyplassen.

Du kan ha krav på inntil 600 euro i erstatning når flyselskapet streiker

Dersom flyet ditt blir innstilt eller forsinket som følge av streik, kan du ha krav på erstatning på inntil 600 euro uavhengig av om du hat hatt et økonomisk tap eller ikke. Dette gjelder selv om du har fått refundert flybilletten din eller flyselskapet har booket deg om.

Denne formen for erstatning er en normalerstatning som har hjemlet i et felles europeisk regelverk med standardsatser for erstatningssummene. Krav på standarderstatning gjelder kun der forsinkelsen eller kanselleringen kommer som følge av en såkalt «ekstraordinær hendelse».

Praksis fra Transportklagenemnda tyder på at streik i egen flyselskap ikke vil anses som en ekstraordinær hendelse, slik at du vil ha krav på inntil 600 euro i erstatning.

Hvor mye erstatning du har krav på beror på hvor langt du reiser og hvor lang forsinkelsen er.

Ved innstilt fly på grunn av streik har du krav på:

  • 250 euro for flygninger inntil 1500 km
  • 400 euro for flygninger innenfor EØS på mer enn 1500 km
  • 400 euro for flygninger utenfor EØS på mellom 1500 km og 3000 km
  • 600 euro for alle øvrige flygninger

Dersom flyet er forsinket på grunn av streik har du krav på:

  • 250 euro per billett for alle flygninger innenfor EØS på inntil 1500 km som blir forsinket med mer enn to timer.
  • 400 euro per billett for alle flygninger innenfor EØS på over 1500 km som blir forsinket med mer enn tre timer.
  • 600 euro per billett på alle øvrige flygninger som blir forsinket med mer enn fire timer.
